On October 6, 2023, the court reporter notified this Court that she had not received a designation of the reporter's record and that payment arrangements for the reporter's record had not been made. That same day, this Court sent appellant's counsel a letter directing counsel to file within ten days notice that appellant has requested preparation of the reporter's record and written verification that appellant has paid or made arrangements to pay for the reporter's record or written documentation that appellant has been found to be entitled to proceed without payment of costs. As of the date of this order, the Court has not received the notice of request for the reporter's record or written verification of payment or entitlement to proceed without payment of costs. Nor has appointed counsel communicated with this Court concerning these appeals.
We ORDER appellant to file with this Court on or before NOVEMBER 20, 2023, those documents or a written statement that appellant does not intend to request a reporter's record. If the Court does not receive those documents by November 20, 2023, the Court may order the appeal submitted without the reporter's record, or the Court may abate the appeal for the trial court to make findings concerning whether appellant is receiving effective assistance of counsel on appeal.
We DIRECT the Clerk to send copies of this order to the Honorable Nancy Mulder, Presiding Judge, Criminal District Court No. 6, Dallas County; Marrisa Garza, Official Court Reporter for Criminal District Court No. 6; and counsel for all parties.
We DIRECT the Clerk to send a copy of this order by first class mail to Paul Belton, TDCJ No. 02464265, Hodge Unit, 379 FM 2972 West, Rusk, TX 75785.
