Belmonte v. State

District Court of Appeal of Florida, Fourth District
Apr 10, 1991
576 So. 2d 1383 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-0282.

April 10, 1991.

Appeal from the Circuit Court for Indian River County; L.B. Vocelle, Judge.

Richard L. Jorandby, Public Defender, and Susan D. Cline, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and James J. Carney, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm the judgments of conviction and sentences in all respects except for the assessment of costs and public defender fees as conditions of the order of probation. It appears those conditions were not imposed by the trial judge and are an administrative oversight. Accordingly, they are stricken.

DOWNEY, GLICKSTEIN and GARRETT, JJ., concur.
