Action to recover damages for breach of contract, brought to the Superior Court in the judicial district of Windham, where the defendant Rock Brothers Tires, Inc., filed a counterclaim for compensation for work performed, and referred to Hon. William P. Barber, state trial referee; after the action was withdrawn against the named defendant et al., judgment was rendered for the plaintiff on the complaint and for the defendant Rock Brothers Tires, Inc., on the counterclaim, from which the plaintiff appealed to this court. No error.
