ORDER

Having reviewed the Report and Recommendation of the Honorable S. Kate Vaughan, United States Magistrate Judge, any objections or responses, and the remaining record, the Court finds and ORDERS:

(1) The Court ADOPTS the Report and Recommendation.
(2) Defendants' Motion to Dismiss, Dkt. 24, is DENIED under Federal Rule of Civil Procedure 12(b)(5), but GRANTED under Rule 12(b)(6). Plaintiff's claims against Snohomish County Jail and Snohomish County Risk Management and as to RCW 4.96 et seq. are DISMISSED with prejudice and any claim against Snohomish County is DISMISSED without prejudice.
(3) The Clerk is directed to send copies of this Order to the parties and to Judge Vaughan.
