PRESENT: , P. J., FAHEY, PERADOTTO, LINDLEY, AND SCONIERS, JJ.

Petitioner having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Seneca on February 20, 2014,

Now, upon reading and filing the affidavit of Elijah Bell sworn to March 20, 2014, the statements of Elijah Bell dated March 26, 2014, and April 7, 2014, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that the brief is filed and served on or before June 2, 2014, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that respondents shall file and serve briefs on or before July 7, 2014, and

It is further ORDERED that the proceeding is removed from the day calendar for June 23, 2014, and the proceeding shall be added to the term of Court commencing October 20, 2014.
