Present — Martin, P.J., Townley, Untermyer, Dore and Cohn, JJ.


The plaintiff's motion for summary judgment was properly denied. The defendant having stipulated to an amendment of the complaint increasing the demand by $145.19, it becames unnecessary to modify the order appealed from in that respect. Order unanimously affirmed, with twenty dollars costs and disbursements to the respondent. Settle order on notice.
