An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about April 29, 2022, And plaintiff-appellant having moved for: (1) reargument of the order of this Court, entered on October 18, 2022 (Motion No. 2022-03323), which denied plaintiff's motion to suppress certain medical records and for permission to prosecute the appeal using a pseudonym; and (2) for an extension of time in which to perfect the appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that plaintiff's motion for reargument of Motion No. 2022-03323 is granted to the extent that upon reargument, plaintiff's motion for a sealing order is granted to the extent of sealing Documents No. 9 filed in AD1 NYSCEF, and granting plaintiff permission to file under seal that portion of the Record on Appeal which includes the psychotherapy notes of Dr. Mikki Meyer, and the medical records and laboratory report from Dr. Bina Mody (i.e., Exhibits 25 and 34 annexed to plaintiff's motion papers filed with this Court on Motion No. 2022-03323); plaintiff's time in which to perfect the appeal is extended to the September 2023 Term of this Court, and the motion is otherwise denied.
