ORDER ADOPTING REPORT AND RECOMMENDATION

Hon. David G. Estudillo United States District Judge

This matter comes before the Court on the Report and Recommendation (“R&R”) of the Honorable Theresa L. Fricke, United States Magistrate Judge. The Court having considered the R&R and the remaining record, and the objections having been filed, does hereby find and order as follows:

(1) The R&R is ADOPTED;

(2) Plaintiff's complaint is DISMISSED without prejudice for failure to file an amended complaint or otherwise respond to the order to show cause; and

(3) The Clerk shall close this case.
