Opinion

December 11, 1951.

Appeal from Circuit Court, Hillsborough County; Henry C. Tillman, Judge.

Macfarlane, Ferguson, Allison Kelly, Tampa, for appellant.

J.D. Hobbs, Tampa, for appellee.

Affirmed.

TERRELL, Acting C.J., and LEWIS, Associate Justice, concur.

CHAPMAN and MATHEWS, JJ., concur specially.

I agree to the affirmance order but think it should be so modified as to permit patrons of appellant to remain on the property until 11 o'clock a.m. Mr. Justice Mathews shares this view and conclusion.

MATHEWS, J., concurs.
