In cause No. 10,391, decided December 30, 1944, the appellant brought before this court his appeal from orders having to do with reference to the appointment of a temporary, and later a permanent receiver, and with the approval of the receiver's account, and the orders were affirmed. Beecher v. Federal Land Bank of Spokane, 9 cir., 146 F.2d 934. On rehearing the matter came before this court in cause No. 10,789, and the decision of this court, 9 cir., 153 F.2d 987, recites "The district court was dissatisfied with appellant's administration of the property and ordered appointed first a temporary and later a permanent receiver. Appellant appeals from these orders and from the order confirming the first report of the receiver.

Appellant contends that all acts of the receiver were void and that certain specific allowances are improper.
Second, even if these claims now made on appeal had been included in a timely § 144 affidavit, they would be insufficient to satisfy the statute. Adverse rulings do not constitute the requisite bias or prejudice of § 144. Berger v. United States, 255 U.S. 22, 34, 41 S.Ct. 230, 65 L.Ed. 481 (1921); Ex parte American Steel Barrel Co., 230 U.S. 35, 43-44, 33 S.Ct. 1007, 57 L.Ed. 1379 (1913); Chessman v. Teets, 239 F.2d 205, 215 (9th Cir. 1956), vacated on other grounds, 354 U.S. 156, 77 S.Ct. 1127, 1 L.Ed.2d 1253 (1957); Beecher v. Federal Land Bank, 153 F.2d 987, 988 (1945), cert. denied, 328 U.S. 871, 66 S.Ct. 1364, 90 L.Ed. 1641 rehearing denied, 329 U.S. 819 (1956); In re Equitable Trust Co., 232 F. 836, 840 (9th Cir. 1916). There is thus no merit to appellant's claim of bias based on adverse rulings.

A judge is not disqualified merely because he believes in upholding the law, even though he says so with vehemence. Baskin v. Brown, 4 Cir., 174 F.2d 391; Foster v. Medina, 2 Cir., 170 F.2d 632. Imposition of sentences which are very severe, but which are within legal limits provided by the statute, does not, standing alone, establish the necessary bias and prejudice. Calvaresi v. United States, 10 Cir., 216 F.2d 891, 900. Adverse rulings during the course of the proceedings are not by themselves sufficient to establish bias and prejudice.
