On December 14, 2017, Bruce Becker, appellant, who is pro se and indigent, filed a motion asking that the clerk's record in this appeal be made available to him via electronic access. The motion is GRANTED. The Clerk of this Court is directed to copy the clerk's record onto a compact disc (CD) and to provide the CD to appellant either in person or by mail.
Additionally, on December 14, 2017, appellant filed a motion to abate this appeal pending the filing of findings of fact and conclusions of law by the trial court. Findings of fact and conclusions of law are not appropriate because the case was disposed of by summary judgment. See IKB Indus. (Nigeria) Ltd. v. Pro-Line Corp., 938 S.W.2d 440, 441-42 (Tex. 1997) (recognizing that findings of fact and conclusions of law have no place in a summary judgment proceeding). Appellant's motion to abate this appeal is DENIED.
The deadline for filing appellant's amended brief remains unchanged. Appellant's amended brief is due on January 8, 2018. It is so ORDERED on December 19, 2017.
