On August 1, 2017, the appellant, Bruce Becker, filed a notice of appeal. On August 7, 2017, the appellant filed an affidavit of inability to pay costs. On August 11, 2017, we issued an order stating that the trial court clerk, the court reporter, or any party could file a contest or objection to the affidavit in this court on or before August 21, 2017. We further stated in our order that if no contest or objection was filed, the allegations in the affidavit would be deemed true and appellant would be permitted to proceed without the payment of the filing fee or the cost to prepare the clerk's record and the reporter's record.
On August 25, 2017, the appellees, Pedro Becker and Manuela Becker, filed a motion to challenge the appellant's claim of inability to pay costs. The appellees' motion was not timely filed. Therefore, the motion is DENIED. The appellant will be permitted to proceed in this appeal without the payment of the filing fee or the cost to prepare the clerk's record and the reporter's record. The clerk's record and the reporter's record are due on November 22, 2017.
