ORDER MODIFYING OPINION AND DENYING REHEARING, NO CHANGE IN JUDGMENT

THE COURT:

It is ordered that the opinion filed herein on July 25, 2005 (131 Cal.App.4th 409; __Cal.Rptr.3d__), be modified as follows:

1. On page 1 [131 Cal.App.4th 409], the name Martin Herschovitz, Judge is changed to Martin Herscovitz, Judge.

2. On page 5, last paragraph [131 Cal.App.4th 415, advance reports, 1st par.], (Evid. Code 916) is changed to (Evid. Code 915).

There is no change in judgment.
