Respondent having moved for an extension of time to file and serve a brief on this proceeding pursuant to Public Officers Law § 36, and petitioner having cross-moved to expedite the proceeding,
Now, upon reading and filing the affirmations of Lisa DiPoala Haber, Esq., dated May 26, 2015, June 4, 2015, and June 11, 2015, the affidavit of Jessica Zambrano sworn to May 26, 2015, the affidavit of Paul Becallo sworn to June 8, 2015, and the affidavit of Constance J. McDonald sworn to June 11, 2015, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that respondent's motion is granted on the condition that the brief is filed and served on or before July 17, 2015, and the Clerk is directed to accept the brief for filing, and
It is further ORDERED that reply briefs, if any, shall be filed and served on or before August 3, 2015, and
It is further ORDERED that petitioner's cross motion is dismissed.
