Feb 23, 1994
632 So. 2d 280 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-0572.

February 23, 1994.

Appeal from the Circuit Court, Broward County, William P. Dimitrouleas, J.

Richard L. Jorandby, Public Defender, and Tanja Ostapoff, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and James J. Carney, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm the conviction but remand for the sentence to be corrected by deleting the court's revocation of defendant's driver's license, since this can only be done by the Department of Highway Safety and Motor Vehicles. Vinyard v. State, 586 So.2d 1301 (Fla. 2d DCA 1991).

Reversed.

WARNER, KLEIN and PARIENTE, JJ., concur.
