ORDER


On March 5, 2004, the United States Magistrate Judge's Recommendation was filed and notice was served on the parties pursuant to 28 U.S.C. § 636. The recommendation was that the defendant's motion for summary judgment should be allowed and that summary judgment be GRANTED for the defendant.

On March 12, 2004 the plaintiff filed objections to the recommendation. Having reviewed those objections de novo, it is determined that the recommendation should be adopted.

IT IS THEREFORE ORDERED that the defendant's motion for summary judgment be GRANTED and that judgment be entered on behalf of the defendant, The Prudential Insurance Company of America.
