The substantial and material evidence standard requires proof beyond a mere "scintilla or glimmer," but less than a preponderance of the evidence. Beal v. Nashville Elec. Tenn. Dep't of Commerce & Ins., 167 S.W.3d 308, 316 (Tenn. Ct. App. 2004)). NES preferred charges against Mr. Mitchell for providing false and misleading information on the employment application he submitted in 2006.
