It is ordered that the opinion filed here in on May 30, 2003, 110 Cal.App.4th 82, [1 Cal.Rptr.3d 454] be modified as follows: 1. On page 16, the first line of the first paragraph reads: Not withstanding defendant's fears, exposing bad faith The line should be changed to read: Not withstanding plaintiff's fears, exposing bad faith There is no change in the judgment. Defendant's petition for rehearing is denied.
