BOARD OF OVERSEERS OF THE BAR Plaintiff v. Donald F. Brown, Esq. of Brewer, ME Me. Bar #008541 Defendant
PROPOSED ORDER ON THE BOARD'S MOTION FOR CLARIFICATION & FURTHER ORDER
Thomas R. McKeon, Superior Court Justice
The Board has moved the Court to clarify and issue further order on three points; entering a deadline for Defendant's repayment of costs, pursuant to Me. Bar. R. 22, requiring Defendant to pay the associated costs of monitoring as required via the Court's October 4, 2022, Sanctions Order, and granting Bar Counsel's office authority to determine who shall serve as Defendant's monitor in the event the parties cannot reach agreement as contemplated in the October 4, 2022, Order.
The Court hereby Orders that Defendant must fully reimburse the Board for costs recoverable under Me. Bar. R. 22 within twenty-one (21) days from the date of this Order. The Court further Orders that Defendant shall assume all costs incurred to effectuate the monitoring requirements of the October 4, 2022, Sanctions Order, as determined by the Monitor. Finally, the Court orders that, in the event the parties cannot reach agreement on who shall serve as monitor within twenty-one (21) days, as outlined in the Sanctions Order, the Board, via Bar Counsel's office, may select the monitor who will be named in the final Monitor Order. In all other respects, the Court's Sanctions Order, dated October 4, 2022, remains in effect.
