ORDER

PER CURIAM

On April 4, 2023 we issued an order abating this appeal. We determined that this case was appropriate for referral to mediation. See Tex. Civ. Prac. & Rem. Code Ann. §§ 154.021-.073. On October 5, 2023 we issued a letter requesting a status on the parties' mediation. On November 7, 2023 we received a mediator's report informing this court that no settlement has been reached. On January 4, 2024 we issued a second order directing the parties to conduct mediation within 30 days. The parties have not complied with this court's order.

Accordingly, we reinstate the appeal on our active docket. Appellant's brief is due 30 days from the date of this order.
