This case is currently before the Court on remand from the United States Court of Appeals for the Fourth Circuit. On August 8, 2022, the Court issued an Order directing the parties in this case to file a joint written report regarding the current status of this case, including any discussions the parties have had with regard to further action needed by this Court in this case. On September 16, 2022, petitioner filed with the Court two documents entitled "First Supplement to Order parties by 10-5-2022 shall file joint report". Both of these documents appear to be a copy of the entire docket record in this case. On September 20, 2022, petitioner filed two additional documents with the Court which appear to be 2011 Instructions for Form 1040NR and Publication 519, U.S. Tax Guide for Aliens for use in preparing 2010 returns both from the Internal Revenue Service. None of these documents filed by petitioner are responsive to the Court's Order served on August 8, 2022. Premises considered, it is
ORDERED that the documents filed by petitioner on September 16, 2022 at Index number 43 and 44 are hereby stricken from the record in this case. It is further
ORDERED that the documents filed by petitioner on September 20, 2022 at Index number 45 and 46 are hereby stricken from the record in this case.
The parties are reminded that there is a joint report due on October 5, 2022 in which the parties shall inform the Court of further action needed by this Court in this case, including whether the parties wish to have a further trial to offer evidence regarding the Court of Appeals mandate.
