ORDER ON APPLICATION
Application by IBEX Construction, LLC, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated October 28, 2011, and an appeal from an order of the same court dated January 27, 2012.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the time of IBEX Construction, LLC, to serve and file a brief is enlarged until January 7, 2013, and the brief of IBEX Construction, LLC, including the points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), must be served and filed on or before that date.
