Before Rodriguez, C.J., Palafox and Soto, JJ.

ORDER

PER CURIAM

The reporter's record was due to be filed on September 8, 2023, with a first request being granted until such time. As of this date, no reporter's record has been filed.

Therefore, the case is abated, and the Court ORDERS the trial court to conduct a hearing to determine whether Appellant wishes to continue the appeal and whether Appellant has been deprived of a reporter's record. The trial court shall forward its findings to the District Clerk of El Paso County, Texas, on or before October 5, 2023. The District Clerk shall prepare and forward a supplemental clerk's record containing the trial court's findings and forward the same to this Court on or before October 15, 2023. Further, the trial court's reporter shall prepare, certify, and file the record of the trial court proceedings with this Court on or before October 15, 2023.

The case will be abated until October 15, 2023, or the hearing record is received, whichever occurs first.

IT IS SO ORDERED.
