ALAN S. BASS, Defendant Below-Appellant, v. STATE OF DELAWARE, Plaintiff Below-Appellee. No. 272, 2003. Supreme Court of Delaware. Submitted: July 17, 2003. Decided: August 4, 2003.

Before HOLLAND, BERGER, and STEELE, Justices.

ORDER

Carolyn Berger, Justice:

This 4th day of August 2003, after careful consideration of the appellant's opening brief and the State's motion to affirm, we find it manifest that the judgment of the Superior Court should be affirmed on the basis of the Superior Court=s well-reasoned decision dated May 2, 2003. The Superior Court did not err in concluding that Bass' motion for postconviction relief was time-barred and that Bass had failed to overcome this procedural hurdle.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
