DIANA FAY BASS, Appellant v. RICHARD H. BASS, Appellee

On Appeal from the 401st Judicial District Court Collin County, Texas
Trial Court Cause No. 401-54722-2015

ORDER

On January 5, 2016, we ordered the appeal submitted without the reporter's record based on a letter from the court reporter that appellant had not requested the record. The following day, appellant, who is pro se, filed a motion seeking an extension of time to file the reporter's record, explaining she did not realize she needed to request the record herself, and stating she would be requesting the record. We construe appellant's motion as a motion to vacate our January 5th order, GRANT the motion, and VACATE that order. We ORDER court reporter Kimberly Tinsley to file the record no later than January 28, 2016. As Collin County's online docket sheet reflects appellant filed an affidavit of indigence and is "eligible," the record shall be filed without prepayment of costs. See TEX. R. APP. P. 20.1.

We DIRECT the Clerk of the Court to send a copy of this order to Ms. Tinsley and the parties.
