ΒΆ 10 A later case involved a charitable corporation which owned a home for orphans. In Barton v. Baptist Gen. Convention,477 P.2d 679 (Okla. 1970), the Court held that land outside the incorporated city limits acquired by the Baptist General Convention of the State of Oklahoma was not subject to the constitutional prohibition. This ruling was based upon a finding of fact by the trial court that the charitable corporation, which intended to use the land for farming, fell within the exception in that farming was "necessary and proper to the corporate purpose and charitable function of maintaining a children's home."
