Action to recover damages for the alleged tortious acts of the defendants, a business agent of an employees' union and a shop steward on plaintiff's job appointed by that union. Plaintiff moved to strike out an affirmative defense alleging the arbitration provisions in an existing trade agreement between an association of which plaintiff is a member and the union, and defendants moved to stay all proceedings in the action pending arbitration under the trade agreement. Order denying plaintiff's motion to strike out the affirmative defense and granting defendants' motion to stay proceedings pending such arbitration, affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Carswell, Johnston, Sneed and Wenzel, JJ., concur. [See post, p. 665.]
