Delivered and Filed: August 20, 2003

Appeal From the 198th Judicial District Court, Kerr County, Texas Trial Court No. 99-648-B Honorable Murray Jordan, Judge Presiding

APPEAL DISMISSED; MOTION TO DISMISS AND TO DISCHARGE SURETY GRANTED

Sitting: Paul W. GREEN, Justice, Sarah B. DUNCAN, Justice, Phylis J. SPEEDLIN, Justice.

MEMORANDUM OPINION

Appellant filed a motion to dismiss this appeal, release the obligations of the surety on appellant's supersedeas bond, and tax appellate costs against the party that incurred them. Appellant states the parties have consummated a compromise settlement agreement that renders this appeal moot, and certifies that appellee does not oppose the motion. We therefore grant the motion and dismiss the appeal. Costs of appeal are taxed against the parties who have incurred them, and the obligations of Ohio Casualty Insurance Company on appellant's supersedeas bond are discharged.
