Judgment reversed on the law and the facts, and a new trial granted, costs to abide the event, upon the ground that the evidence presented a question of fact for the jury. ( Williams v. City of New York, 214 N.Y. 259.) Kelly, P.J., Rich, Jaycox Kelby and Young, JJ., concur.
