DONALD SHADRACK BARRETT, Appellant, v. THE STATE OF TEXAS, Appellee.

Appeal from County Criminal Court No. 7

of Dallas County, Texas

(TC# M1346037H)

ORDER

The reporter's record in the above styled and numbered cause was originally due February 20, 2014. The Court has extended the due date once on its own motion and has granted three extensions requested by the Court Reporter. The Court granted the last extension until May 23, 2014 as a second final extension. The reporter's record has not been filed as of this date and the Clerk's Office has been unsuccessful in its efforts to contact the court reporter.

It is therefore ORDERED that the trial judge conduct a hearing to determine whether appellant has been deprived of a reporter's record for any reason, including ineffective assistance of counsel, and to make appropriate findings and recommendations, which may include appointment of new counsel. The record of such hearing, including any orders and findings of the trial judge, shall be certified and forwarded to this office on or before July 9, 2014.

IT IS SO ORDERED this 4th day of June, 2014.

PER CURIAM Before McClure, C.J., Rivera, and Rodriguez, JJ.
