ORDER
Adam B. Landy Special Trial Judge
On November 8, 2022, the Commissioner filed a Motion to Dismiss for Lack of Prosecution. In the motion, the Commissioner stated that Moses Barrett, III, has been nonresponsive to his communication attempts to resolve this case. On April 18, 2023, the Court held a conference call with the parties to discuss the Commissioner's motion. At the conclusion of the call, the Court stated that it would allow Mr. Barrett a final opportunity to confer with the Commissioner to possibly resolve this case without a trial.
Upon due consideration of the Commissioner's motion, the conference call held with the parties on April 18, 2023, and for cause, it is
ORDERED that the Commissioner's Motion to Dismiss for Lack of Prosecution, filed November 8, 2022, is held in abeyance. It is further
ORDERED that, no later than May 31, 2023, the parties shall meet and confer, in person, by telephone conference or electronic mail, to discuss all issues raised by Mr. Barrett in his petition filed April 14, 2015. It is further
ORDERED that, on or before June 2, 2023, the parties shall file a status report (preferably a joint report) detailing the then-present status of the case.
Mr. Barrett is reminded of possible assistance available to respond to this Order and any other issues through low-income taxpayer clinics which can be found on the Court's website at https://www.ustaxcourt.gov/clinics.html and a list is also attached to this Order.
