Petition for review granted; transferred to Court of Appeal, First Appellate District, Division Four, with directions to issue an alternative writ
Petitioner's and respondent's motions to seal are granted. (Cal. Rules of Court, rules 2.550(d), 8.46(b).) In ordering the sealing, this court makes the findings required by California Rules of Court, rules 2.550(d) and 8.46(d)(6). The clerk of this court is directed to file the unredacted petition, the unredacted answer, and the unredacted reply under seal.
Petitioner's application for permission to submit declarations of co-counsel is denied.
The petition for review is granted. The matter is transferred to the Court of Appeal, First Appellate District, Division Four, with instructions to issue an alternative writ on the issue of whether the Contra Costa County Superior Court erred by refusing to authorize any funds for petitioner's investigator to consult with defense counsel, and by refusing to authorize “extensive efforts” to locate witnesses.
The stay previously issued by this court is to remain in effect pending further order of the Court of Appeal.
