STIPULATED DISMISSAL OF ACTION WITHOUT PREJUDICE AND ORDER THEREON


WHEREAS, the Plaintiff asked in his lawsuit that the Defendants be ordered to move forward his application for naturalization without further delay, and

WHEREAS, the Defendants have interviewed the Plaintiff on his application, and

WHEREAS the Defendants and the Plaintiff agree that such interview provides the Plaintiff with judicial review rights under 8 U.S.C. 1447(b), and

WHEREAS, Plaintiff has received the relief that he was seeking in his mandamus lawsuit in that his case has now moved forward, and

WHEREAS, this particular case is now moot,

NOW, THEREFORE, the parties hereto, by and through their respective counsel, hereby stipulate that this action may now be dismissed without prejudice.

IT IS SO ORDERED.
