The judgment is affirmed. Barnicle is to have his costs on appeal. Barnicle has also applied for just damages under Mass.R.A.P. 25, as amended, 378 Mass. 925 (1979). We shall entertain a claim for such damages (presumably the legal fees incident to appeal) upon presentation of a motion to the court, accompanied by an affidavit.
