CARL B. BARNEY, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Christian N. Weiler Judge.

On February 28, 2023, the parties filed a joint status report which states that this case is with the Independent Office of Appeals for consideration and potential resolution. Based on the pendency of this matter in Appeals, the parties have agreed to pause discovery efforts and have not conferred on a pretrial schedule or a trial date. The report further states that the parties continue to anticipate that, should the case proceed to trial, the trial could last more than a week, and will involve multiple experts and fact witnesses and in the event that this case is not resolved in Appeals, the parties intend to file a joint motion for pretrial scheduling order that will include expert witness reports, discovery requests, stipulations of fact, and other trial preparation matters.

Accordingly, it is

ORDERED that on or before May 5, 2023, the parties shall file a joint report and inform the Court of status of this case.
