DOCKETING STATEMENT PURSUANT TO CIRCUIT RULE 3(c)
The district court had jurisdiction of this action, which asserted claims under the Civil Rights Act of 1871, 42 U.S.C. Sec. 1983, and a supplemental state law tort claim, pursuant to 28 U.S.C. § 1331 (general federal question jurisdiction) and 28 U.S.C. § 1367 (supplemental jurisdiction over state law claims). The Western District of Wisconsin is the proper venue for this action because the Plaintiff's claims arose within the geographical boundaries of the Western District of Wisconsin within the meaning of U.S.C. § 1391(b).
This Court has jurisdiction of this appeal pursuant to 28 U.S.C. § 1291. The district court entered an Opinion and Order granting the Defendants' Motion for Summary Judgment and dismissing the Plaintiffs' constitutional claims with prejudice and the Plaintiff's state law claim without prejudice (dkt. #32), on March 21, 2022. The court entered judgment dismissing the case (dkt. # 33), on the next day, March 22, 2022.
No motion for a new trial, nor for alteration of the judgment, nor any motion claimed to toll the time within which to appeal, has been filed since the entry of the March 22, 2022, judgment. The Plaintiff timely filed this appeal by electronically filing a Notice of Appeal with the district court clerk on March 30, 2022. There have been no prior or related appellate proceedings.
