Barker v. Greve

Appellate Division of the Supreme Court of New York, First Department
Apr 1, 1927
220 App. Div. 716 (N.Y. App. Div. 1927)

Opinion

April, 1927.

Present — Dowling, P.J., Merrell, Finch, McAvoy and Proskauer, JJ.

Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs. Defendant Lewis H. Greve apparently suffered a deliberate default in actions upon promissory notes. Lack of a meritorious defense, as well as laches, bars defendant. In addition no proposed answer is before this court.
