PETER E. BARKER-HOMEK & SHAY SERDY, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent
ORDER
Elizabeth A. Copeland Judge
This case is calendared for trial at the Dallas, Texas Trial Session of the Court set to commence on Monday, October 24, 2022.
On June 29, 2022, respondent filed a Motion to Proceed Remotely. On July 6, 2022, petitioners filed an Objection to Motion to Proceed Remotely. On July 7, 2022, the parties and the Court conducted a conference call to discuss the motion and objection, along with other issues affecting the case.
During the July 7, 2022, conference call, the document-intensive nature of the case was discussed, along with COVID-19 protocols to be implemented to protect the health of the parties during an in-person proceeding. In connection with such health-related protocols, it was agreed that some exhibits could be electronically shared rather than sharing paper copies of exhibits; the parties agreed to work together on the logistics of that issue. It was also agreed that the case would benefit from being set for a time and date certain.
After due consideration, and for cause, it is
ORDERED that respondent's Motion to Proceed Remotely, filed with the Court on June 29, 2022, is denied and the trial in this case will proceed in-person as scheduled. It is further
ORDERED that this case is set for trial at a time and date certain of Tuesday, October 25, 2022, at 8:30 a.m. CT during the Court's October 24, 2022, Dallas, Texas Trial Session. The parties shall continue to follow the Standing Pretrial Order for that trial session that was served on them when the case was initially calendared.
