HECTOR BARAJAS, Appellant, v. THE STATE OF TEXAS, Appellee.

Do not publish. Tex.R.App.P. 47.2(b).

On appeal from the 430th District Court of Hidalgo County, Texas.

Before Chief Justice Contreras and Justices Longoria and Peña

ORDER OF ABATEMENT

PER CURIAM

This cause is before the Court on the reporter's fourth request for an extension of time to file the reporter's record. The reporter's record in this matter was originally due on August 14, 2023. The reporter has previously requested and received three extensions of time to file the record. On January 8, 2024, the Clerk of the Court notified the reporter's record was now due to be filed on or before February 16, 2024, and that no further extensions would be granted absent exigent circumstances. On February 21, 2024, the Clerk of the Court notified the reporter that the reporter's record had not been timely received.

The Court, having fully examined and considered the extensions previously granted in this cause, is of the opinion that, in the interest of justice, the reporter's request for extension of time to file the record should be granted by order. The extension requested by reporter, Velma A. Arellano, is granted, and she is hereby ordered to file the reporter's record in this Court no later than 5:00 p.m. on March 22, 2024.

Furthermore, the Court abates and remands this cause to the trial court. The trial court shall determine what, if any, steps are necessary to ensure the prompt preparation of a reporter's record and shall enter any orders required to avoid further delay and to preserve the parties' rights. The trial court shall prepare and file its findings and orders, if any, and cause them to be included in a supplemental clerk's record which should be submitted to the Clerk of this Court within ten days.
