CRAIG SMITH JUSTICE

Before the Court are appellee's motion to dismiss the appeal as untimely and appellants' motion for an extension of time to file their notice of appeal. We GRANT appellants' motion. The notice of appeal filed by appellants on March 22, 2021 is deemed timely for jurisdictional purposes. Accordingly, we DENY appellee's motion as moot.

The motions filed by Receiver James Volberding to substitute in as counsel for appellant BAPA Brooklyn 2004, LLC and to dismiss the appeal remain pending. 1
