CIVIL ACTION NO.7:07-CV-21 (HL).
April 3, 2007
ORDER
Plaintiff JOSHUA SIMPSON BANKS, an inmate at the Hays State Prison in Trion, Georgia, has filed a pro se civil rights complaint under 42 U.S.C. § 1983. He also sought leave to proceed without prepayment of the filing fee or security therefor pursuant to 28 U.S.C. § 1915(a). In an Order dated March 13, 2007, the Court granted plaintiff's motion to proceed in forma pauperis and ordered that he pay an initial partial filing fee in the amount of $4.00. Plaintiff has now paid the initial partial filing fee. Plaintiff will have to pay the full amount of the $350.00 filing fee, as explained later in this Order.
Plaintiff alleges that when he as incarcerated at Valdosta State Prison on May 11, 2006, Officers Maine and Hollis both punched him several times in the face, chest, and body. Plaintiff states that he suffered a broken jaw, black eye, and "mental illness" as a result of the attack. Although it is not clear that plaintiff will ultimately prevail on the merits, the Undersigned finds that plaintiff has made sufficient allegations to withstand the frivolity review. Accordingly, it is hereby ORDERED that service be made as provided by law upon defendants and that they file a Waiver of Reply, an Answer, or such other response as may be appropriate under Rule 12 of the FEDERAL RULES OF CIVIL PROCEDURE, U.S.C. § 1915, and the Prison Litigation Reform Act.
It is further ORDERED AND DIRECTED that a copy of this order be served upon plaintiff's custodian, if any.
