THE COURT.—It is ordered that the opinion filed herein on May 19, 2005 (129 Cal.App.4th 706; 28 Cal.Rptr.3d 825), be modified in the following particulars:

On the first page of the slip opinion [129 Cal.App.4th 709, advance report], counsel for appellants is listed as follows: “Harry Pascuzzi and Susan L. Moore for Defendants and Appellants.” The sentence is modified to state as follows: “Pascuzzi, O’Neill & Moore and Susan L. Moore for Defendants and Appellants.”

This modification does not effect a change in the judgment.
