The court hereby adopts the Magistrate Judge's Recommendation.

IT IS THEREFORE ORDERED that Defendant's motion to dismiss Plaintiffs claim for attorneys' fees (Third Claim for Relief in the Complaint) be GRANTED. See Pleading No. 5.
