Appellant having moved for reconsideration of the order of this Court entered December 4, 2012, denying permission to proceed as a poor person, assignment of counsel, and permission to file a late appeal from an order of the Supreme Court entered in the Office of the Clerk of the County of Orleans on January 9, 2012, and for other relief,

Now, upon reading and filing the affidavit of Agnes Banach sworn to January 18, 2013, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.
