ORDER TO SHOW CAUSE

This case is currently calendared for trial at the Session of the Court commencing on November 18, 2024, in Philadelphia, Pennsylvania. On September 20, 2024, respondent's counsel filed a Motion to Dismiss for Lack of Prosecution. In her motion, respondent's counsel states that on May 8 and June 26, 2024, she and petitioner held a telephone conference to discuss a potential settlement of this case based on documentation that petitioner had provided to the Internal Revenue Service Independent Office of Appeals; however, at the June 26, 2024, conference, petitioner stated that she wanted to seek advice before agreeing to the settlement. Respondent's counsel further states that on July 26, August 26, and September 18, 2024, she attempted to contact petitioner via telephone but was unsuccessful, and she was unable to leave a voicemail message. Finally, respondent's counsel states that she is uncertain as to whether petitioner objects to the granting of her motion. It would be helpful for the Court to hear from petitioner regarding respondent's counsel's motion and the status of this case. Upon due consideration, it is hereby
ORDERED that petitioner shall contact the chambers of the undersigned Judge at (202) 521-0822 as soon as possible for the purpose of scheduling a conference call to discuss the Motion to Dismiss for Lack of Prosecution, filed September 20, 2024, and the status of this case. It is further
ORDERED that petitioner shall show cause in writing, on or before October 23, 2024, why this case should not be dismissed for lack of prosecution.
