RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE


This matter was before the Court for a final pretrial conference on April 26, 2004. Attorney Thomas M. Van Camp appeared on behalf of Plaintiff Erica Baldwin. Defendants failed to appear at the conference after being duly notified of the same by the Clerk of this Court. The notice expressly warned Defendants that failure to appear at this conference could result in a judgment of default against them.

After conferring with counsel for Plaintiff Baldwin, the Court enters the following recommendation:

In light of Defendants' failure to appear at this final pretrial conference, the settlement conference and mediation, IT IS HEREBY RECOMMENDED that the Court enter a judgment of default against Defendants pursuant to Rule 16(d) and (f) of the Federal Rules of Civil Procedure.
