ORDER
On April 28, 2004, the United States Magistrate Judge's Recommendation was filed and notice was served on the parties pursuant to 28 U.S.C. § 636(b). No objections were received by the court within the time prescribed by the statute.
The court hereby adopts the Magistrate Judge's Recommendation.
IT IS THEREFORE ORDERED that default judgment will be entered against Defendants, but the amount of damages must be determined by the Court before final judgment is entered. Determination of damages is REFERRED to the Magistrate Judge pursuant to Fed.R.Civ.P. 53. The parties are directed to the provisions of Rule 53. This Order gives notice of the appointment, and the parties may be heard further on the appointment if they so elect. See Rule 53(b)(1). The Magistrate Judge's duties include conducting an evidentiary hearing to determine damages, and entering a Recommendation thereon. The Magistrate Judge shall not communicate ex parte with the undersigned; shall make a record of the hearing; and shall file a Recommendation for review under Rule 72(b).
