Baldan appeal from a nonfinal order of partial summary judgment. We reverse.

Genuine issues of material fact on the issue of whether the appellee assigned its right to payment to Baldan precluded the entry of partial summary judgment in this case. Holl v. Talcott, 191 So.2d 40 (Fla. 1966).

Accordingly, the partial summary judgment is reversed, and the cause is remanded for further proceedings.

Reversed and remanded.
