Baird v. Martinez

District Court of Appeal of Florida, First District
Apr 11, 1989
541 So. 2d 751 (Fla. Dist. Ct. App. 1989)

Opinion

No. 87-1884.

April 11, 1989.

An Appeal from the Circuit Court for Leon County; William L. Gary, Judge.

Robert A. Casterline, Donald J. Harrell, and Robert P. Jurzyk, pro se.

Robert A. Butterworth, Atty. Gen., Marilyn K. Morris, Asst. Atty. Gen., Tallahassee, for appellees.

AFFIRMED.

SHIVERS and BARFIELD, JJ., concur.

ZEHMER, J., specially concurs, with opinion.

I concur in affirming the dismissal of the complaint because it fails to allege legally sufficient grounds for holding section 944.276(1)(c), Florida Statutes (1987), facially unconstitutional for violation of the equal protection clause. I do believe, however, that appellants should be given leave to amend.
