District Court of Appeal of Florida, Second District.

163 So. 3d 1188 (Fla. Dist. Ct. App. 2014)

Opinion

Nos. 2D14–4201 2D13–4426.

Ronnie Earl BAILEY, Jr., Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).

Opinion

BY ORDER OF THE COURT.

The petition for belated appeal is dismissed as it was erroneously initiated as a new proceeding. The petition seeks belated discretionary review of this court's denial of petitioner's petition alleging ineffective assistance of appellate counsel in case 2D13–4426. Upon receipt of petitioner's original petition for belated appeal in July 2014, the petition was forwarded to the Florida Supreme Court, as it was the proper forum. See Fla. R.App. P. 9.141(c)(3). The supreme court then dismissed the petition as the relief petitioner seeks is not available in either the supreme court or this court.
